Acceptance of Terms

By accessing and using the Ekasfe S.A. platform, you accept these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you should not use our platform.

• 'Platform': The Ekasfe website and mobile applications.
• 'User' or 'Investor': Natural or legal person registered on the platform.
• 'Developer': Company or person requesting financing for real estate projects.
• 'Project': Real estate development available for investment on the platform.
• 'Investment': Loan made by an investor to a developer through the platform.

Eligibility

To use Ekasfe you must:

• Be at least 18 years old.
• Have legal capacity to enter into contracts in Ecuador.
• Provide truthful and up-to-date information during registration.
• Not be disqualified from conducting financial operations.
• Comply with applicable anti-money laundering laws.

Platform Services

Ekasfe provides a technology platform that connects investors with real estate project developers. Ekasfe is not a financial institution and does not guarantee investment returns. We act as an intermediary facilitating transactions between parties.

Investment Risks

Investing in real estate crowdlending carries risks, including:

• Risk of total or partial loss of invested capital.
• Risk of delay or default in payments.
• Liquidity risk: investments cannot be easily sold.
• Real estate market risk: fluctuations in property values.
• Developer risk: developer's inability to complete the project.

User Obligations

As an Ekasfe user, you commit to:

• Maintain the confidentiality of your access credentials.
• Immediately notify any unauthorized use of your account.
• Provide accurate and up-to-date information.
• Not use the platform for illegal activities.
• Comply with tax obligations arising from your investments.

Intellectual Property

All content on the platform, including texts, graphics, logos, icons, images, and software, is the property of Ekasfe or its licensors and is protected by Ecuador's intellectual property laws and international treaties.

Limitation of Liability

Ekasfe shall not be liable for direct, indirect, incidental, or consequential damages arising from the use of the platform or investments made. Our total liability is limited to the amount of fees paid by the user in the last 12 months.

Termination

Ekasfe may suspend or terminate your access to the platform in case of breach of these terms, fraudulent or suspicious activities, or by requirement of competent authorities.

Dispute Resolution

Any dispute related to these terms shall be resolved through arbitration administered by the Arbitration and Mediation Center of the Quito Chamber of Commerce, in accordance with its current regulations. The seat of arbitration shall be Quito, Ecuador.

Governing Law

These Terms and Conditions are governed by the laws of the Republic of Ecuador. Any matter not covered by these terms shall be resolved in accordance with applicable Ecuadorian legislation.
